When don't you need a permit?

To do so, you must take the following conditions into account, among others:
- All freestanding outbuildings combined may not exceed 40 m² in total;
- The maximum height is 3.5 meters;
- In the side yard, you must leave at least 3 meters from the property line ;
- in the backyard, at least 1 meter;
- The structure must be located within 30 meters of the residence .
For example, do you already have a freestanding garden shed measuring 10 m²? If so, that area counts toward the 40 m² limit, leaving a maximum of 30 m² remaining for other freestanding outbuildings, such as your patio cover.
What if the patio cover is attached to your house?
Will your patio cover be permanently attached to your home? If so, different rules apply than for a freestanding canopy.
Before March 1, 2026, a simple notification was still sufficient for certain attached structures. That rule has been abolished. This means that you should not cannot simply be considered exempt from a permit, even if it is smaller than 40 m².
